For those who really want to understand the implications of IP and why it is such a key weapon in a company's technology arsenal, and also a field of landmines, Bruce Berman's The Intangible Investor is necessary reading. Berman has been writing about the use and impact of intellectual property, well before it was fashionable. And because few understood the issues, he was forced to write about the subject in a disarmingly jargon-free and explanatory style.

Many of us are intangible investors - unseen stakeholders with an interest in what is provided by patents and other innovation rights, intangible assets by accounting definition. While IP rights may be owned by individuals or assigned to companies, how they are deployed, and by whom, is what gets most people riled up. The preceding decade's challenge was to discern "How are IP rights assets?" For the coming one it will be "How can IP rights best be used to support innovation?"

Berman's commentaries are excellent primers for understanding how the discussion around IP has evolved. Berman rightly points out that the complexity of the IP process and the difficulty in enforcing one's claims may have deterred many companies from getting involved. The lack of data also makes the valuation task difficult. But once patent auctions and other similar events happened, the task of mark-to-market became much easier. Companies that still shy away from valuing their IP aren't simply undervaluing their assets but also shortchanging their investors. Many patent owners still don't want to believe that patents can be sold or traded like tangible assets.

The Intangible Investor is not a complete guide to the IP discussion. But until another book comes out to discuss IP rights this may be the most illuminating set of commentaries - on the past, present and future of IP.

Bruce heads Brody Berman Associates in New York, a communications management firm that helps patent and other IP holders to improve understanding and generate higher returns.

The Intangible Investor - The Insights from a Visionary and a Veteran Deal-maker

“New economy”, “intangible economy”, and “innovation-driven economy” …. We have read and heard about all of these since the dot com bubble. However, it would take a true visionary to forecast how the intangiblization of our economy will unfold. Bruce Berman is such a visionary. Reading the articles in The Intangible Investor that he wrote over the course of more than a decade, you would think that he was talking about today’s hot topics in IP industry. For example, he discussed the issues about patent troll in 2004 (Illegitimate Assertions?, page 29). Quite frankly, I would wish that both sides of the current debate over NPE or patent troll had taken a page from his book.

Most importantly, Bruce Berman is not only a visionary, but also a deal-maker. He is a veteran IP consultant and an entrepreneur in the industry. In this book, he explains the economics and finance of intellectual property, and provides many insights about IP market and transaction. If you are one of the IP market participants and are interested in monetizing or investing in IP assets, you definitely want to read The Intangible Investor.

A good read for IP managers, investors, and entrepreneurs

Bruce has done a great job putting all these chapters together. The book reviews the IP and patent in the past 15 years. It covers all the recent controversial events in the IP world, including the pros and cons of different practices in IP, why it has become such an important part of business, and why it demands the attention of CEOs. It extensively covers subjects such as NPEs, valuation and its challenges, and issues such as patent quality. The chapters are somewhat independent and readers can choose based on their preference. It is a good read for everyone interested in IP; however, I highly recommend it to IP managers, investors, and entrepreneurs who want to take a crash course and quickly become up to date about the state of IP today and develop an understanding of what has happened in the past 15 years, which may mark one of the most important periods in patent history.

Bruce Berman has done it again! The Intangible Investor is the latest book by Berman to show that intellectual property is the key to the success of an economy. This time with a chronology of how the IP landscape is changing, and how a corporation cannot afford to lack an IP strategy is obvious from this book. Anyone who is thinking of an IP strategy or trying to keep up with the even changing face of the patent landscape should benefit from reading this book.

The idea of US being the only place where IP is thought of as a strategic investment, is now gone out of the window. China and other economies are perhaps much more aggressive in looking at IP as an investment. With 80% of a company's valuation being intangible assets, it is imperative that a concerted strategy towards IP is the way to go.

This is a must read for corporate strategists, licensing professionals as well as aspiring IP investors.
